New Hampshire - NH Gun Laws

No state permit or license is required to buy a rifle, shotgun, or handgun in New Hampshire. Every dealer purchase runs through the standard federal background check (NICS via Form 4473), with the usual federal age minimums — 18 for a long gun, 21 for a handgun. There's no state waiting period and no state-added purchase restrictions beyond what federal law already requires.

New Hampshire does not require a permit or background check for private firearm sales or transfers between residents. Buying from a private party rather than a licensed dealer means no NICS check, no state permit, and no paperwork trail under state law. Federal law still applies — a private seller may not knowingly transfer to someone they believe is a prohibited possessor.

New Hampshire follows the standard federal prohibited-persons categories: felony conviction, certain domestic violence convictions or active protective orders, unlawful drug users, individuals adjudicated mentally defective or committed to a mental institution, fugitives from justice, dishonorable military discharge, undocumented immigration status, and renunciation of U.S. citizenship. New Hampshire does not layer significant additional state-specific categories on top of the federal list, and the state has no red-flag/extreme risk protective order law.

Permitless since 2017 — anyone 18 or older who can legally possess a firearm may carry concealed without a permit, background check at the point of carry, or training requirement. New Hampshire still issues an optional carry license for residents who want one, mainly useful for concealed carry reciprocity when traveling to states that don't recognize New Hampshire's permitless standard. As of July 15, 2026 (HB 1365), applying for that optional license got simpler too, the state dropped the requirements to list personal references, employment information, and personal medical or mental health history on the application.

No permit or license is required to carry a handgun, loaded or unloaded, concealed or openly, in a vehicle in New Hampshire. The one notable exception: loaded long guns (rifles and shotguns) are prohibited in motor vehicles — long guns being transported in a car should be unloaded, unlike the state's more permissive handgun rule.

New Hampshire's restricted-location list is short: K-12 schools, courthouses, and state/federal government buildings are the main categories under state and federal law. Beyond that, New Hampshire leaves relatively little off-limits compared to most states, consistent with its overall permissive framework.

New Hampshire does not set a comprehensive statewide minimum age for possessing a firearm beyond the federal purchase-age framework (18 for long guns, 21 for handguns through a dealer). Supervised possession and use by minors — for hunting, target shooting, or firearms safety instruction under adult supervision — is common practice and not separately restricted by a dedicated state age-floor statute.

None. New Hampshire has no magazine capacity limit and no assault weapons ban, and state preemption law (RSA 159:26) blocks any city or town from creating one locally.

New Hampshire is a stand-your-ground state (RSA 627:4) — no duty to retreat before using force, including deadly force, anywhere you're lawfully present, as long as you're not the initial aggressor and reasonably believe force is necessary. Castle Doctrine is separately codified (RSA 627:7), covering use of force in defense of premises. A 2026 law, HB 1279, signed July 15, 2026 and effective January 1, 2027, adds a specific affirmative defense for using deadly force in defense of a third person, not just yourself.

New Hampshire has strong, explicit state preemption under RSA 159:26 — local governments cannot enact their own firearm regulations beyond what state law allows. Expect statewide consistency on purchase, possession, and carry rules almost everywhere in the state.
